The Securities and Exchange Commission (Filipino: Komisyon sa mga Panagot at Palitan, commonly known as SEC) is the agency of the Government of the Philippines charged with the registration and supervision of corporations and securities, as well as capital market institutions and participants, in the Philippines. As such, the Commission champions investor protection in the Philippines, as part of its mandate.

An agency under the Department of Finance, the SEC is headquartered at 7907 Makati Avenue, Barangay Bel-Air, Makati City. It has nine extension offices located in Baguio, Tarlac, Legazpi, Iloilo, Bacolod, Cebu, Cagayan de Oro, Davao and Zamboanga.

The major functions of the SEC include the registration and supervision of corporations, including financing and lending companies. It is also charged with the registration of securities, analysis of every registered security, and the evaluation of the financial condition and operations of applicants for security issues. The SEC is among the few securities commissions in the world that simultaneously acts as a corporate registrar and a securities regulator. Such a dual role allows the Commission a comprehensive view of the business and investment landscape and for a more coordinated and enabling regulatory environment.

SEC collects from job applicants personal information, such as but not limited to, full name, birth date, birth place, sex, civil status, height, weight, blood type, Government Service Insurance System ID Number, Pag-ibig ID Number, Philhealth Number, Social Security System Number, Taxpayer Identification Number, citizenship, residential and permanent addresses, contact number, family background information, spouse’s information, father’s and mother’s names, educational background, civil service eligibility or licenses and ratings, and signature. 

SEC collects, uses and/or processes personal information based on electronic and paper documents submitted by applicants.

As government agency, SEC is mandated to comply with the Civil Service Commission (CSC) regulations on recruitment, selection, appointment and other human resource actions in the civil service. The collected information are required by the CSC Personal Data Sheet (PDS) and other applicable civil service regulations.

The collected personal information will be utilized to evaluate the qualifications of the applicants

Personal and other information collected through the submitted documents are stored in a secure data facility. The SEC has adequate security safeguards to protect information from loss, unauthorized access, use or disclosure.

The documents are retained for a period of one (1) year and after such retention period, paper documents shall be shredded and the electronic files shall be completely deleted in accordance with the applicable rules of the National Archives of the Philippines Act and Data Privacy Act.

Under the Data Privacy Act of 2012, data subject refers to an individual whose personal information is collected and processed. SEC is duly bound to observe and respect your privacy rights, including your right to information, right to access, right to correct, right to remove, right to damages and right to data portability.

History

The SEC was established on 26 Oct 1936 by virtue of the Commonwealth Act No. 83 or the Securities Act. Its establishment was prompted by the need to safeguard public interest in view of local stock market boom at that time. Operations began on 11 Nov 1936 under the leadership of Commissioner Ricardo Nepomuceno. Its major functions included registration of securities, analysis of every registered security, evaluation of the financial condition and operations of applicants for security issue, screening of applications for broker’s or dealer’s license and supervision of stock and bond brokers as well as the stock exchanges. The agency was abolished during the Japanese occupation and was replaced with the Philippine Executive Commission. It was reactivated in 1947 With the restoration of the Commonwealth Government. Due to the changes in the business environment under Pres. Ferdinand Marcos, the agency was reorganized on 29 Sept 1975 as a collegial body with 3 commissioners and was given quasi-judicial powers under PD902-A. 

In 1981, the Commission was expanded to include two (2) additional commissioners and two (2) departments, one for prosecution and enforcement and the other for supervision and monitoring. Then on 01 December 2000, the SEC was reorganized as mandated by R. A. 8799 also known as the Securities Regulation Code.
