Executive Order No. 126 (January 31, 1987) created the National Conciliation and Mediation Board (NCMB) as an agency attached to the Department of Labor and Employment (DOLE). The NCMB absorbed the conciliation, mediation, and labor-management functions of the Bureau of Labor Relations and its counterparts in the regional offices of the Department. The NCMB shall formulate policies, develop plans and programs and set standards and procedures relative to the promotion of conciliation and mediation of labor disputes through the preventive mediation, conciliation and voluntary arbitration; facilitation of labor-management cooperation through joint mechanisms for information sharing, effective communication and consultation and group-problem solving.

The NCMB, as a staff and line office, has the following functions: (a) Formulate policies, programs, standards, procedures, manuals of operations and guidelines pertaining to effective mediation and conciliation of all labor dispute. (b) Perform preventive mediation and conciliation functions. (c) Coordinate and maintain linkages with other sectors of institutions, and other government authorities concerned with matters relative to the prevention and settlement of labor disputes. (d) Formulates policies, plans, programs, standards, procedures, manuals of operations and guidelines pertaining to the promotion of cooperative and non-adversarial schemes, grievance handling, voluntary arbitration and other voluntary modes of dispute settlement. (e) Administer the voluntary arbitration program; maintain/update a list of voluntary arbitrators, compile arbitration awards and decisions. (f) Provide counseling and preventive mediation assistance particularly in the administration of collective agreements
(g) Monitor and exercise technical supervision over the Board’s programs being implemented in the regional offices; and (h) Perform such other functions as may be provided by law or assigned by the Secretary.

About NCMB

Conciliation is a mild form of intervention by a neutral third party, the Conciliator-Mediator, who relying on his persuasive expertise, takes an active role in assisting parties by trying to keep disputants talking, facilitating other procedural niceties, carrying messages back and forth between the parties, and generally being a good fellow who tries to keep things calm and forward-looking in a tense situation. 

Conciliation-mediation is a mode of dispute settlement that brings together two disputing parties to negotiate and settle their differences. It is a process of rational and orderly discussion of differences between the parties to a dispute under the guidance of a Conciliator-Mediator.

To differentiate, conciliation is a mild form of intervention by a neutral third party, the Conciliator-Mediator, relying on his persuasive expertise, who takes an active role in assisting parties by trying to keep disputants talking, facilitating other procedural niceties, carrying messages back and forth between the parties, and to keep things forward-looking in a situation. Mediation is an intervention through the Conciliator-Mediator, whereby he starts advising the parties or offering solutions or alternatives to the problems with the end in view of assisting them towards voluntarily reaching their own mutually acceptable settlement of the dispute.

The DOLE, through the National Conciliation and Mediation Board (NCMB), promotes conciliation-mediation as the preferred mode of resolution of unfair labor practices and bargaining deadlock issues to prevent notice of strikes/lockout and preventive mediation cases from maturing into actual work stoppages. In case of actual work stoppage, conciliation-mediation mode services continue to settle the disputes at the earliest possible time to prevent or minimize its effect to the workers, company and the economy.
